Specifically, Article 6 of the decree establishes that, in order to enable the official controls required by Regulation (EC) No. 882/2004, economic operators must notify the competent local health authority of the location of the establishments where the activities required by Regulation (EC) No. 2023/2006 are carried out.
Only establishments that deal exclusively with distribution to the final consumer (e.g., supermarkets and retail outlets) are exempt from this obligation.
The objective of the regulation is to enable health authorities to properly map and monitor businesses in the sector, ensuring the safety of materials intended for food contact. A census process of establishments producing or handling materials and objects intended for food contact is completed by registering the establishments on the TRACES NT portal.
Upon completion of this process, properly registered establishments appear on the portal with the wording “Establishment – Status: Valid.”
Starting November 17, in order to request import certification (NOA or CHED, as applicable), the establishment must be registered and in “Valid” status on the TRACES NT portal.
In the absence of such registration, some Border Control Posts (BCPs) have introduced a transitional exemption procedure: the import authorization will be issued even if the operator can demonstrate that they have already submitted the establishment’s registration request, accompanied by the receipt protocol, to the competent ASL.
This way, it will still be possible to demonstrate that the procedure has been correctly initiated. A communication template shared with all Regions is available for use in transmitting the required information to the competent Authority. We attach the template along with the provisions of the Ministry of Health and the Directorate General for Liguria, Piedmont, and Valle d’Aosta.
